Terms and Conditions for Viva Application and Job Placement.

1. Right to Modify Terms:

The Agency reserves the right to amend, modify, or update these Terms and Conditions at its sole discretion, without prior notice or liability. It is the responsibility of the client to regularly review these Terms and Conditions to stay informed of any changes.

2. Payment as Acceptance: 

By submitting payment for the viva application or job placement services, the client acknowledges and agrees to be bound by all the terms and conditions outlined herein.

3. Interpretation of Terms:

The Agency reserves the exclusive right to interpret, amend, or revise these Terms and Conditions as deemed necessary.

4. No Guarantee of Employment:

Submission of payment for the viva application or job placement services does not guarantee employment in Oman. Successful selection for the viva is a prerequisite, but passing the viva, security checks by the Royal Oman Police, and any other additional screening required by the employer is required for employment consideration. Joining the process without confirming and disclosing any already known disqualifying factor or documented criminal conviction or disability that will impact your ability to carry out the duty for the position applied, will lead to forfeiture of all funds paid up to the point of disqualification.

5. Service Charges: 

The total service charge will be announced either in the academy or at the appropriate time and may be subject to change as the agency deems fit.

6. Exchange Rate: 

All currency conversions will be based on the exchange rate provided by the Oanda foreign exchange site (available at oanda.com) at the time of payment.

7. Breakdown of Service Charges

The service charge will be divided into two components/installments: 

   a. The Viva fee, and 

   b. The Job Finder’s fee.

8. Payment for Viva Fee: 

The Viva fee must be paid in full before the Viva.

9. Non-Refundable Viva Fee: 

The Viva fee is non-refundable, regardless of the outcome of the viva.

10. Viva Fee Contribution:

The Viva fee contributes to the total service charge only if the candidate successfully passes the Viva.

11. No Contribution for Failed Viva:

If the candidate fails the viva, the failed Viva fee will not be credited toward the total service charge.

12. Subsequent Viva Attempts:

Any subsequent attempts at the viva will require payment of the full Viva fee, as stated above.

13. Payment Accounts:

Payments must be made to the designated accounts provided by the Agency. If the account details are not provided, the candidate must request this information and not assume, as separate account details could be used for separate payments.

14. Job Finder’s Fee Payment – First Installment: 

The first installment of the Job Finder’s fee must be paid from any point after the candidate is informed of their success in the viva to when evidence of the candidate’s offer letter readiness is provided, but before the release of the offer letter.

15. Job Finder’s Fee Payment – Second Installment:

The second installment of the Job Finder’s fee (if not paid in full) must be paid at any point between the receipt of the offer letter and when the candidate’s visa is ready for issuance, but before the visa is sent to the candidate.

16. Timing of Entry into Oman: 

The duration between passing the viva, completing the administrative recruitment process, and entering Oman is at the sole discretion of the employer. The Agency will not be held liable for delays, and clients must refrain from applying undue pressure on the Agency during this waiting period.

17. Orientation Course Requirement:

Candidates must complete an orientation course provided by the Agency, as mandated by the Nigerian Federal Ministry of Labour and Manpower. This course should be completed at any time between passing the viva and departing for Oman.

18. Job Contract Terms:

The benefits outlined in the official job contract will take precedence over any prior promises made to the candidate during the recruitment process. These benefits may be updated or modified by the employer at their discretion and without consulting the Agency.

19. Candidate Responsibility for Viva Outcome: 

While the Agency provides viva preparation courses and assistance, the candidate is solely responsible for the outcome of their viva examination.

20. Right to Review Service Charges:

The Agency reserves the right to review and adjust the Viva and Job Finder’s fees, including percentages to be paid in various installments based on its independent market assessment and organizational goals and objectives. Any such review will be communicated to the candidate before payment for the viva. Once payment for the viva has been made, the agreed-upon service charge is final and cannot be changed by either party.

21. Full Payment Requirement:

Candidates must ensure they have sufficient funds to cover the entire service charge or secure/guaranteed financing plans before paying for the viva, to avoid delays in the recruitment process after successfully passing the viva.

22. Right to Review Candidate Selection for Viva:

The Agency reserves the right to modify the order or selection process for candidates eligible to take the viva, as deemed necessary.

23. Premium Viva Slots:

The Agency reserves the right to allocate premium viva slots to candidates who may not have been selected for a particular batch based on the sequence, provided these candidates are willing to pay an additional premium fee.

24. Payment Timing for Viva: 

Candidates should only make payment for the viva after receiving an official selection notification from the Agency through one of its recognized communication channels.

25. Forfeiture of Viva Fee for Missed Viva:

Failure to attend the scheduled viva examination will result in the forfeiture of the viva fee. Any subsequent attempts will require the full payment of the viva fee, and candidates must ensure they are fully prepared with functional devices, stable internet connections, and a conducive environment for the exam. There is no provision for cancellation of Viva once payment and booking has been made.

26. Resit Policy for Failed Viva:

If the candidate fails the viva, the Agency will determine the timing for a subsequent viva attempt based on factors including waitlist, status, readiness of other candidates, and the Agency’s assessment of the candidate’s preparedness. Candidates are not entitled to an automatic resit slot in the next batch.
